Steven Maijoor (AFM): EU en VS moeten probleem erkenning toezichthouders op accountants oplossen
De Europese Unie en de Verenigde Staten moeten snel met een oplossing komen voor de problemen met betrekking tot de wederzijdse erkenning van bevoegdheden van hun toezichthouders op accountantsorganisaties. Dit zei AFM-directeur Steven Maijoor vandaag in Rome tijdens een conferentie van het internationale netwerk van accountantskantoren PKF.
In september gaf eurocommissaris McCreevy in een brief aan de Amerikaanse PCAOB aan dat het voor Europese accountantskantoren onwettig is om mee te werken aan inspecties van de PCAOB.
Op grond van Europese regelgeving kunnen toezichthouders op het accountantsberoep in de Europese Unie op basis van wederkerigheid en gelijkwaardigheid accountantsdossiers uitwisselen met toezichthouders van buiten de EU. Om zo'n afspraak te maken met de VS moet daar echter de Sarbanes-Oxley Act worden aangepast. McCreevy zei toen niet te verwachten dat deze aanpassing er snel zou komen.
Europese kantoren die in Amerika bij de PCAOB staan geregistreerd, bevinden zich hierdoor op dit moment in een rare situatie. "If they want to comply with US legislation (Sarbanes-Oxley Act and PCAOB rules) they need to violate their national legislation based on the Statutory Audit Directive."
In zijn speech doet Maijoor een beroep op de politiek om de problemen uit de wereld te helpen. "I strongly urge the European and US legislators to solve this issue. The oversight bodies are not in the position to solve this problem. In this context I hope that the pending amendment of SOX will move quickly through the US political process."
"Bringing organizations that we supervise in a position that they need to violate a law is against one of the fundamental objectives we try to achieve as regulators."
Maijoor pleit daarnaast voor de instelling van een Europese toezichthouder voor accountants. "As I mentioned earlier, a week ago the first small steps were taken for truly European oversight in the areas of banking, insurance and the securities industry. For each of the three areas, an ESA (European Supervisory Authority) will be established. It has become popular to say 'never waste a good crisis'. The establishment of the three ESAs is an example of not wasting this crisis and is one of the positive results of the current political momentum. I hope that as soon as possible these steps will be copied for the auditing area and that the Fourth ESA will be the European Auditing Authority (EAA). The need for this step is obvious: auditing is one of the most important pillars for well-functioning banking, insurance and securities markets."
